Condos do not have to be apartments.

There are condominum developments of detached houses. The only difference between a Condo House and a Single House is that it is on Common Land, often with Pools and Gyms and Clubhouses.

Because it is a Condominium, you legaaly own it 100%

On the negative side the Condo House is subject to similar rule to Condo Apartments

Not sure if this is what you are looking for, but its an alternative that has not been expressed in this thread yet.

Tuktukmike,

I agree that if the relevant thai ministries would decide to critically review the share structure of small companies that currently own say 1-3 pieces of land and decide that these were invalid and had to be liquidated the property market around the thai coast would be in big trouble.

As far as I know however they have not hinted at doing this. The directive everyone is taliking about is quite clear about that the review should take place at land transfer (not share transfer or an overall overwiew of fixed property holding companies)

Do you know something I do not or do you have another interpretation that I might have overlooked?

From time to time there are various paranoid stories about the “risks” of investing in Thailand. Yes Thailand is not the U.K., Europe or Australia (which is why we love the place), and different rules will apply from time to time. However, Thailand is firmly anchored in the direction of becoming a major economic force. At present it has the 22nd largest economy in the world. The increasing integration with the world economy by any country means that capricious acts of economic xenophobia are less likely.

If you want to make the move, and can afford the move, then consult a good local lawyer, and make sure that you have your structures set up correctly. The same advice applies no matter where you want to settle/invest.

If that were the case you would have been banned a year ago.

This is a discussion board, everyones opinions and experiences are welcome whether we agree with them or not.

Lev i just found this post so i feel i must reply. I assume you are refering to the tuk-tuks.

Everyone knows what i do and i make no secret of this fact.

I do not use HHAD as a vehicle to sell my products and to date heve never sold any tuk tuks here..

I always advise people here to buy a tuk-tuk from Bangkok as there is no need for a European standard one here, which of course you know.

When people buy my product please remember that they will own it 100% and not just part of it.

We did have a talk regarding a page and as you know this was only for rating purposes as I have no interest in the Thai Market.

Hope this clears things up for you.

Well yet again ttm and the moderators have lost the plot and forgotten the original thread. I have stated before that I believe Farangs driving around in expensive suvs with the names of land agents emblazoned on them only serve to antagonise the local middle class. Farang developers manipulating the rules of their host country to cheat that countries government of revenue serve to antagonise the government officials and staff. I myself was sent a message by a high official in Hua Hin on Friday that the reason that I could progress no further with my request was because the developer involved had quote" cheated his government" and I have to say I see no reason to disbelieve him. These are the very people who can sway a government and actively incite the lower class's If you think logically about the present political situation in Thailand then you will understand that there is a caretaker government currently installed. They are attempting to be all things to all people as they are all seeking re-election I believe in October. Unfortunatley the vast majority of Thai people have had very little or no education and are easily led by powerfull people. Khun Thaksin may have become very arrogant, not dissimilar to at least two recent PMs in the UK but he understands that Thailand needs to accomodate the outside world to progress. I sincerely hope that the Thai rak Thai are reinstalled at the next election and that Khun Thaksin can drive home his message about taking on board the sensible fair farang. If you lie and cheat then I hope you receive your just rewards. My message to everyone is sit back and behave sensibly, after the election we will see the resumption of normal service.

I think there has been a misunderstanding here. My reply to your quip about HHAD being a vehicle for property agents had one clear meaning. If we were what you suggested why would we allow your anti-property prose on the board? It has nothing to do with tuk-tuks, hope this clarifies things.

Not quite correct.

As Lev well knows the post you mention was not done by myself and all was explained to Lev when i returned from UK.

I dealt with what was going on at that time and for now i will leave it at that.

Getting back on subject,

I read this today,

Lists Attached to the Foreign Business Act B.E. 2542 (1999)

LIST ONE

The businesses not permitted for foreigners to operate due to special reasons:

(1) Newspaper business, radio broadcasting or television station business.

(2) Rice farming, farming or gardening.

(3) Animal farming.

(4) Forestry and wood fabrication from natural forest.

(5) Fishery for marine animals in Thai waters and within Thailand specific economic zones.

(6) Extraction of Thai herbs.

(7) Trading and auctioning Thai antiques or national historical objects.

(Cool Making or casting Buddha images and monk alms bowls.

(9) Land trading.

How do property developers get work permits?

Buying up large pieces of land and reselling them must be land trading or not.

I also heard that Farangs can not get work permits as sales agents but of course this info may be wrong,

Let me supply the way forward.

Put your companies in the thai wif
es name and hey presto all ok.

I will ask our friendly imm person about this as it seems unclear as to who can legally do what when it comes to property or land.

Great time to get into the leasing market though.

I think the part you are missing is that when a foreigner sets up a limited company where Thai's have the majority of shares (51%) it then becomes a Thai company and not a foreign company, and can therefore operate in the restricted areas listed under the Foreign Business Act (FBA).
Ofcourse, the crux of the issue is whether or not the company is a legit Thai limited company based on the Thai shareholders being 'nominees'.
When we all call them 'foreign limited companies' we are all wrong, they are in fact 'Thai Limited Companies', again leaving aside the legitimacy of the Thai shareholders.
If a foreigner was dealing in a busniess NOT restriced under the FBA, then he would not need to limit his shares to 49%.

That's how work permits can be granted.
